J Lucas Coaching Limited Terms and Conditions

This page sets out the terms that apply when you book coaching services with J Lucas Coaching Limited. It is designed to explain the arrangement clearly, including sessions, fees, cancellations, confidentiality and your consumer rights.

These terms and conditions apply to all coaching and mentoring services provided by Julian Clifton Lucas trading through J Lucas Coaching Limited (the “Coach”) to any individual or organisation purchasing those services (the “Client”).

Together, they form the contract between the Coach and the Client.

In these terms, “coaching” includes life coaching, personal coaching, personal development coaching, executive coaching, business coaching and, where relevant, mentoring or supervision services.

By purchasing coaching services and proceeding to a first session, you confirm that you have read, understood and accepted these terms.

All coaching services and communications provided by Julian Clifton Lucas, whether by email or otherwise, together with the information on the website (jlucascoaching.co.uk), are intended to support you in addressing challenges, gaining clarity and moving forward with greater well-being.

Coaching is not a substitute for medical care, mental health care or other regulated professional advice.

Julian Lucas aims to maintain a high standard of service. At the end of the coaching process, or after a series of sessions, the Client may be invited to provide feedback.

Coaching Disclaimer

By booking coaching, you acknowledge and agree to the following:

• Coaching is not a substitute for medical care, mental health care, counselling, psychotherapy or substance misuse treatment.

• Coaching is not intended to diagnose, treat or cure any medical or mental health condition.

• Coaching is currently an unregulated industry in the United Kingdom, and the Coach is not licensed by a UK regulator solely by reason of providing coaching services.

• You remain responsible for your own well-being, choices, decisions and actions during and after coaching.

• Any comments, ideas or suggestions offered by the Coach are intended only to support you in working towards your goals.

• The Coach does not guarantee any particular personal, professional, financial or business outcome.

Data Protection

Your information will be treated as confidential unless you agree otherwise in writing.

However, confidentiality may be limited where disclosure is required by law, by court order, or where the Coach reasonably believes disclosure is necessary to address a serious risk of harm to you or another person.

Data Security

You acknowledge that communications by email, text message, telephone, WhatsApp, Skype and similar technologies involve some confidentiality and security risks.

Waiver

To the extent permitted by law, the Coach is not liable for losses arising solely from decisions, actions or omissions taken by the Client during or after the coaching relationship.

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

The Client confirms that they have not relied on any statement or promise not expressly set out in these terms. This agreement binds and benefits the parties and, where relevant, their permitted successors and personal representatives.

Terms and Conditions

The coaching schedule will be agreed between the Coach and the Client and may be booked up to 3 months in advance.

• Julian Lucas may recommend a session frequency based on the Client’s requirements.

• Any recommendation is not binding.

• The schedule may be changed by agreement during the coaching relationship.

Where no specific number of sessions is agreed, sessions will be provided on a session-by-session basis.

In return for the fees payable by the Client, or by a third party on the Client’s behalf, Julian Lucas will provide the services described in these terms. The Client remains responsible for payment obligations unless otherwise agreed in writing.

The date of the first coaching session will be treated as the service start date.

If the Client has any concern about these terms, they should raise it with Julian Lucas before the first session.

Attendance at the first session confirms acceptance of these terms.

Format of Sessions

Sessions are usually held by telephone, Skype, FaceTime Audio, WhatsApp audio or direct telephone call, unless otherwise agreed.

Unless otherwise agreed, the Client is responsible for initiating the call and Julian Lucas is responsible for being available at the agreed time.

The length of each session will be the length selected by the Client at the time of booking.

A session may continue beyond its booked length only by mutual agreement and only where the Coach has no immediate conflicting commitment.

Session Fees

Current fees are stated on the website and will be confirmed at the time of booking.

Julian Lucas may change fees from time to time, but any session already booked and paid for in advance will be honoured at the rate applied when the booking was made.

Dates and Times of Sessions

The date and time of the first and any subsequent session will be confirmed in advance by email.

Julian Lucas will use reasonable efforts to maintain the availability presented on the website and to honour sessions booked through the Acuity Scheduling platform, subject to these terms.

Sessions can only be rearranged in accordance with the section in these terms and conditions headed “Rearranging Sessions”.

Payment Terms

Fees may be paid using the following methods:

• debit card

• credit card

• PayPal through the Stripe payment gateway linked to the Acuity Scheduling platform

• bank transfer or standing order, where agreed

Receipts and invoices are available on request and will be sent by email where requested.

Fees are payable in advance of each session unless otherwise agreed.

For some business coaching arrangements, payment may instead be due on invoice.

If payment due in advance has not been received before the session, Julian Lucas is not required to provide that session.

Where payment is due on invoice, Julian Lucas may charge reasonable interest or administrative costs on late payment where permitted by law and made clear in advance.

Between Sessions

Julian Lucas may suggest tasks or exercises between sessions. The Client is not obliged to complete them, but choosing not to do so may affect progress.

The Client may contact Julian Lucas between sessions by telephone or email for clarification of points arising from a session or for administration, such as rearranging a session or making payment.

Additional coaching support may be available between sessions for an extra charge, but no such charge will be made without the Client’s prior agreement.

Rearranging Sessions

If the Client needs to rearrange a session, the following applies:

• At least 48 hours’ notice should be given wherever possible.

• Where at least 48 hours’ notice is given, the session will usually be rearranged and any fee already paid will normally be transferred to the rearranged session.

• If less than 48 hours’ notice is given, or if the Client does not attend, Julian Lucas may retain the session fee or make a reasonable cancellation charge reflecting the loss caused by the late cancellation or non-attendance, subject always to the Client’s statutory rights.

• In exceptional circumstances, Julian Lucas may need to rearrange a session. Where practicable, at least 48 hours’ notice will be given, and the Client will be offered a rearranged session or, where appropriate, a refund for the cancelled session.

Where the Client pays for one or more sessions in advance, those sessions should normally be used within 6 months of payment.

If sessions remain unused after that period, Julian Lucas may review the circumstances and, where reasonable, offer an extension or apply the remaining value as a credit towards future sessions.

Nothing in this clause affects the Client’s statutory rights.

Confidentiality

Personal and business information shared during coaching will be kept confidential and will not be disclosed to a third party without the Client’s consent, except where disclosure is required by law or is necessary to address a serious risk of harm.

Early Termination

In exceptional circumstances, including illness, bereavement, unavailability, inappropriate behaviour by the Client or an actual or potential conflict of interest, Julian Lucas may end the services early or decline to provide further sessions.

Where practicable, reasonable notice will be given and any advance payment for sessions not yet provided will be refunded.

Responsibilities

Julian Lucas will use reasonable care and skill in providing coaching services. The Client remains responsible for their own decisions and for implementing any actions arising from coaching. No particular outcome is guaranteed and nothing in this clause affects the Client’s statutory rights.

Variation of Terms and Conditions

If an initial number of sessions has been agreed, any change intended to apply before those sessions are completed will only be effective if agreed by both parties in writing.

In other cases, Julian Lucas may change these terms, including session fees, by giving at least one week’s written notice.

If the Client does not wish to continue after receiving notice of a change, they may end further services immediately by written notice and will be entitled to a refund of any fees paid in advance for sessions not yet provided.

Governing Law

This agreement is governed by the law of England and Wales, and the courts of England and Wales will have jurisdiction in relation to any dispute arising from it.

Feedback is welcomed and may be given during a session or by writing to julian@jlucascoaching.co.uk.

Refund Policy

If you buy coaching services as a consumer online, by telephone or by another distance method, you may have a legal right to cancel within 14 days beginning on the day after the contract is made under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

If you ask for coaching to begin during that 14-day period, you expressly request early performance.

If you then cancel within the 14-day period, you must pay for the services provided up to the date of cancellation, and any refund will be reduced proportionately.

If the services have been fully performed within the 14-day period after your express request, you may lose the right to cancel.

Nothing in this policy affects your statutory rights.

This Agreement shall begin on the date hereof.

J Lucas Coaching Ltd does not filter, edit, publish or review Comments before their presence on the website. Comments do not reflect the views and opinions of J Lucas Coaching Ltd, its agents, and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions.
